ORDINANCE ADOPTING A PUBLIC RECORD

An ordinance of the City Council of the City of Willcox, Arizona, relating to Title 5, Business, of the Willcox Municipal Code, Chapter 5.01, Business Permit and Chapter 5.02, Temporary Business Permit, by reference and fixing the effective date thereof; repealing Chapter 5.04, Peddlers, of the Willcox Municipal Code; preserving rights and duties that have already matured and proceedings that have already begun thereunder and providing penalties for the violation thereof.

BE IT ORDAINED by the City Council of the City of Willcox, Arizona, as follows:

Section 1 : That certain document known as "Business Permit" and "Temporary Business Permit", three copies of which are on file in the office of the City Clerk, which documents were made public records by Resolution No. 2003-05 of the City Council of the City of Willcox, Arizona are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance, the provisions thereof to become effective on the 1st day of January 2004.

Section 2 : Any person found guilty of violating any provision of this code shall be guilty of a petty offense. Each day that a violation continued shall be a separate offense punishable as prescribed in Arizona State Law.

Section 3 : Title 5, Business, of the Willcox Municipal Code, Chapter 5.01, Business Permit and Chapter 5.02, Temporary Business Permit and all ordinances and all parts of ordinances in conflict with the provisions of these ordinances or any part of the code adopted herein by reference are hereby repealed, effective as of the 1st day of January 2004.

Section 4 : The repeal of Chapter 5.04, Peddlers of the Willcox Municipal Code, effective as of the 1st day of January 2004, does not effect the rights and duties that matured or penalties that were incurred and proceedings that were begun before the effective date of the repeal.

Section 5: If any section, subsection, sentence, clause, phrase or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
