RESOLUTION NO. 2004-13
A RESOLUTION BY THE MAYOR AND COUNCIL OF THE CITY
0F WILLCOX, COCHISE COUNTY, ARIZONA, EXPRESSING THE INTENT TO TERMINATE
THE DEDICATED RIGHTS OF WAY FOR INGRESS-EGRESS ON THE REAL PROPERTY
LOCATED WITHIN THE CITY LIMITS TO BE TRANSFERRED TO THE FEDERAL
GOVERNMENT FOR THE PURPOSE OF DEVELOPING A BORDER PATROL STATION OR SUCH
OTHER SIMILAR FACILITY ON THE SAID REAL PROPERTY

| WHEREAS, the City of Willcox has
certain real property located in the city limits of the City of Willcox
which is surplus to its needs; and
WHEREAS, the Federal Government of the United States of
America has expressed an interest in establishing and developing a
Border Patrol Substation in the Willcox, Arizona area; and
WHEREAS, in accordance with Arizona Revised Statutes (A.R.S.)
'9-405, the City of Willcox is permitted to transfer real property that
is surplus to its needs to the Federal Government; and
WHEREAS, in accordance with Arizona Revised Statues (A.R.S.)
§28-7205, §28-7206, the City of Willcox is permitted to terminate the
dedicated rights of way for ingress-egress, following that all notices
and ordinances procedures are properly implemented.
THEREFORE, BE IT RESOLVED, by the Mayor of the City of Willcox
and the Willcox City Council that the Said Real Property to be donated
to the Federal Government shall have all dedicated rights of way
terminated.
NOW THEREFORE, BE IT RESOLVED, that the Mayor and City Council
of the City of Willcox, Cochise County, Arizona, transfer to the Federal
Government of the United States of American, real property consisting of
approximately twenty (20) acres, (See Exhibit A), located at Rex Allen
Jr., Road, and that all dedicated rights of way for ingress and egress
be terminated through the City's official ordinance process.
As described above, the City shall reserve the rights of reversion
and the above-described restrictions shall run with the land. The City
Staff is instructed to follow the provision of A.R.S. '9-405 to
effectuate this transfer.
